Expert Opinion: Legislation, Ethics and a Scathing High Court Judgement

This talk examines in-depth the important features of legislation governing various psycho-legal assessments. The talk covers the Children's Act (38 of 2005), the Child Justice Act (75 of 2008), and the Road Accident Fund Act (Act 15 of 1996), which are relevant in South Africa. The talk also examines in some depth a 2019 High Court judgement (Muller v Muller, 2019) which was very critical of work done by some of the professionals providing their professional opinion. This judgement therefore provides clear direction to practitioners on what to do and what not to do when providing expert opinion. Learnings from this judgement are applicable to many professionals providing expert opinion in South Africa.
